Terms & Conditions
General
The following Terms and Conditions shall be applicable to all offers and transactions made by the SELLER – Native Seeds. The term seeds, goods and products as used hereafter shall mean not only seeds, but also plants and parts of plants or any other genetic material of plant species and commodities sold by the company. Placing an order includes acceptance of the terms and conditions set out below.
Quotations and Availability
Species availability and quotations available by contacting Native Seeds by mail, e-mail and telephone. All quotations and prices are in Australian dollars. Prices may be subject to change without notice. Please note that availability is highly dependent on seasonal factors. We are GST inclusive on our website
Cancellation of Orders
Orders once placed may only be cancelled with the seller’s consent.
Refund Policy
No goods may be returned without first obtaining authorisation from the seller. No returns will be considered unless they are in the original, unopened packaging of the seller. Any goods returned will be at the expense of the buyer, unless otherwise approved by a Native Seeds authorised representative.
Edible Seeds
Reference to edible seeds expressly excludes the seeds we sell for propagation. It is the resultant crop only that may be considered edible.
Seed Counts
Seed counts provided are calculated by independent seed labs from a representative sample and therefore can only be used as an approximation for your guidance.
Shipments to Western Australia
Orders shipped to Western Australia – WA quarantine requires all bulk seed orders imported into WA to be inspected by Dept of Agriculture and Fisheries prior to dispatch. Each order will contain a certificate containing the required ‘OK to WA’ documentation when sent from Native Seeds warehouse and will be attached to the packaging of the product.
Shipments to Tasmania
Orders shipped to Tasmania – TAS quarantine allows seeds for sowing only to be imported. It is the importer’s responsibility (importer being the individual purchasing the seeds from Native Seeds) to adhere to Tasmanias biosecurity and importation regulations. Information regarding these requirements can be found here.
The importer must submit a completed ‘“Notice of Intention to Import Seed for Sowing” form to Biosecurity Tasmania (contact details here) at least 24 hours before the import arrives in Tasmania.
Payment
Payment can be made by cheque, money order, credit card or electronic funds transfer. Please contact us for EFT banking details. The buyer shall pay for the goods in advance of delivery unless other arrangements are agreed to between the parties. Overdue payments may attract interest payments and cost recovery charges when accounts are placed with a collection agency.
Dispatch
Orders are dispatched via Australia Post unless otherwise arranged. Ownership of seed and any risks associated with transportation passes to the buyer upon our delivery to the Post Office or other designated place of transport. Wherever possible dispatch of orders is charged at cost although we reserve the right to charge a small handling fee in some cases
Product weights
Invoice weights are Nett weight at the time of packing, small variances may occur due to air moisture levels during transport or storage.
Warranty and Limitation of Liability
Although we will use reasonable endeavours to satisfy any buyer complaint in relation to the goods, owing to the variables associated with the collection, cleaning, treatment and response of biological material we provide no guarantee of success in seed germination and genetic purity of seed or for the accuracy of technical advice provided, and all warranties, representation, promises, conditions or statements regarding these factors whether expressed or implied and whether statutory or otherwise are to the full extent permitted by law hereby expressly excluded. Native Seed’s liability for losses arising from these factors is limited to: the replacement of the seed or the supply of equivalent seed; the payment of the cost of replacing the seed or of acquiring equivalent seed or having the seed supplied again.
Placing an order includes acceptance of the above terms and conditions.
